1. Governing Terms
These terms and conditions (“Agreement”) constitute the entire understanding between you (“Buyer”) and Top Plus Trading Inc. (“We/Our Company”) regarding your use of our website and purchase of products. Any modifications to this Agreement must be in writing and signed by an authorized representative of Our Company. If any provision is deemed invalid, the remaining provisions shall remain enforceable.
2. Order Acceptance
- Order Confirmation: Orders are confirmed via email upon placement, containing details of products, prices, and delivery terms. Prices are final at checkout and include all applicable taxes (unless stated otherwise).
- Binding Agreement: Your order constitutes a legally binding offer to purchase, which we accept by confirming shipment or providing digital delivery.
3. Product Substitution
- General Policy: We strive to fulfill orders as specified. In the rare event of product unavailability, we will notify you and seek your consent before substituting with a comparable item of equal or higher value (e.g., same denomination, edition, or collector status for stamps).
- Opt-Out Right: You may decline substitution by notifying us within 24 hours of order confirmation, after which we will cancel the order and issue a full refund.
4. Prices and Payments
- Price Validity: Prices are valid at the time of checkout and include any applicable discounts. Shipping fees and taxes are calculated separately and displayed before payment.
- Payment Methods: We accept major credit cards, PayPal, and other specified payment methods. All transactions are processed securely through third-party providers.
- Currency: Prices are displayed in Canadian Dollars (CAD) unless otherwise stated.
5. Shipping and Delivery
- Shipping Terms: Orders are shipped from our Canadian warehouses. Risk of loss or damage transfers to you upon delivery confirmation (e.g., signature or safe placement).
- Delivery Times: Refer to our Shipping Terms for estimated delivery windows. Delays due to carrier issues or customs (if applicable) are beyond our control, but we will assist in tracking your order.
- F.O.B. Term: For Canadian orders, shipping is defined as “Delivery at Place” (DAP), meaning we cover costs to deliver to your specified address.
6. Packaging and Special Requests
- Standard Packaging: Products are packaged to ensure safe delivery at no extra cost.
- Special Packaging: If you require additional packaging (e.g., for fragile or high-value stamps), notify us before checkout. Additional fees may apply, clearly stated at the time of request.
7. Title and Risk of Loss
- Title Transfer: Ownership of products transfers to you upon full payment and successful delivery (as confirmed by tracking information or signature).
- Damage Claims: Report any shipping damage or discrepancies within 14 days of delivery via email to support@kxvqzb.com, accompanied by photos of the item and packaging. We will coordinate with the carrier and provide a replacement or refund.
8. Warranty and Returns
- Product Warranty: All stamps are guaranteed to be as described (e.g., condition, authenticity, edition). This includes an implied warranty of merchantability and fitness for ordinary collector purposes, as required by Canadian law.
- Defect Claims: If a product is defective or misrepresented, notify us within 30 days of delivery. We will provide a full refund or replacement at our expense.
- Return Policy: Non-defective items may be returned within 14 days of delivery for a refund (excluding shipping costs), provided they are in original, unused condition with all packaging.
9. Force Majeure
We are not liable for delays or failures to perform due to events beyond our control, such as natural disasters, strikes, government actions, or carrier disruptions. In such cases, we will notify you promptly and extend deadlines as necessary.
10. Limitation of Liability
- Maximum Liability: Our total liability for any claim, regardless of legal theory, shall not exceed the purchase price of the specific product giving rise to the claim.
- Excluded Damages: We do not liable for indirect, consequential, or punitive damages (e.g., loss of investment value in collectible stamps), except as required by law.
11. Compliance with Canadian Law
- Legal Jurisdiction: This Agreement is governed by the laws of Ontario, Canada, and any disputes will be resolved in the courts of Ontario.
- Labor Standards: We comply with the Canadian Labour Code and all applicable provincial labor laws in our operations.
12. General Provisions
- Assignment: You may not assign this Agreement without our consent. We may assign our rights to affiliated companies or successors.
- Entire Agreement: This document supersedes all prior agreements and constitutes the full terms between us.
